Terms and Conditions for Participants

• “Be A Podcastar” (the “Contest”) is organised by Mediacorp Pte Ltd (“Mediacorp” or “We, our, us”). The Contest will be governed by these Terms and Conditions and the official rules and instructions set out on the Contest website (the “Official Rules”), and by participating in this Contest, you agree to be bound by these Terms and Conditions, the Official Rules and by all Contest rules and guidelines which may be prescribed by Mediacorp from time to time. Mediacorp reserves the right to amend or vary any of these Terms and Conditions or the Official Rules without prior notice to you.
• The Contest is open to all between the ages of 15 to 25, residing in Singapore (including as a citizen, permanent resident or on a Singapore student visa) as of the date of participation in the Contest and throughout your participation in the Contest. If necessary, you will show us a copy of your NRIC, passport, birth certificate and/or visa upon our request for verification purposes.
• Full-time employees of Mediacorp and any related/affiliated companies and their respective immediate family members are not eligible to participate in the Contest.
• If you are below the age of 18, you shall be required to obtain your parent/legal guardian’s consent before participating in the Contest. For avoidance of doubt, in respect of participants below the age of 18, references to “you” or “the participant” shall include each the participant’s parent or legal guardian.
• As part of your registration and participation in the Contest, you will be required to produce and submit an original podcast (the “Submission”) in accordance with the requirements set out in the Official Rules.
• Shortlisted participants may be required to attend and participate in training sessions, recording sessions, promotional and publicity events and/or other Contest-related activities at various stages of the Contest, in accordance with such schedules as determined by Mediacorp. You shall ensure that you make yourself available to participate in the various segments of the Contest, including all training and recording sessions, and to render all reasonable assistance to Mediacorp in its conduct promotion, marketing, publicity or obtaining sponsorship for the Contest.
• As a condition to participating in this Contest, you warrant and undertake that:
  1. your Submission does not infringe upon or violate any proprietary rights including without limitation, copyright, the right of privacy or publicity, nor constitute defamation against, nor violate any common law rights or any other rights of any person, firm or corporation;
  2. where your Submission incorporates any materials owned by third parties, you shall obtain all necessary clearances and/or licenses from such third parties (i) for the use of such materials in your Submission; and (ii) in favour of Mediacorp for Mediacorp’s use of the Submission (incorporating such third party materials) in perpetuity across all media throughout the world. Where required by Mediacorp, you shall provide all documentation evidencing such clearances and/or licenses; and
  3. you absolutely assign the entire copyright and all other rights in and to the Submission and all other materials submitted to Mediacorp in connection with the Contest (collectively, the “Materials”) such that Mediacorp shall have the exclusive right, in perpetuity, to utilise and/or reproduce the Materials (and/or any part thereof throughout the world in any and all media whether now in existence or developed in the future. You acknowledge that there will be no payment or royalties due to you at any time from our use of the Materials and you waive irrevocably in respect of your contribution to the Contest any and all “moral rights” which you may have now or in the future including but without limitation any of your rights under the Copyright Act of Singapore or any similar laws of any jurisdiction and acknowledge Mediacorp’s right to use your name, likeness and voice and any biological details, photographs and recordings of you separately from or in conjunction with the Contest or the sponsorship thereof in all media and formats throughout the Universe including but not by way of limitation on Contest – related websites or other online media and in advertising, publicity, sponsorship and exploitation and material.
• You confirm that you are not subject to any contractual or other arrangement which might prohibit or prevent your participation in the Contest or our reproduction and use of the Submission in accordance with these Terms and Conditions.
• You shall indemnify and keep Mediacorp and its related/affiliated companies, officers, agents and employees (the “Indemnified Parties”) fully indemnified against any and all loss, damage, claims and costs (including legal costs on a full indemnity basis) suffered and/or incurred by any of the Indemnified Parties as a result of your breach of any of these Terms and Conditions and/or failure to fulfil your obligations hereunder.
• You agree to take part in any promotions or interviews relating to the Contest which may be conducted by us and that we may record your participation in such promotions or interviews and you agree to absolutely assign all rights, including copyright, you may have in such materials, to us.
• You acknowledge and agree that you may be audio or video taped and/or photographed while participating in any part of the Contest whether or not you are aware that you are being taped, recorded or photographed (collectively, the “Recordings”) and that such Recordings may be disseminated on television and/or all media now known or hereafter devised, in any and all manner throughout the world in perpetuity. With full title guarantee and without limitation to any other rights granted to us hereunder, you hereby irrevocably assign to us (including present assignment of future copyright) the entire copyright and all other rights of whatsoever nature in and to your contributions to the Contest, including but not limited to submissions, pilot production, appearances and interviews, such that we shall be entitled to edit, use and exploit and license others to use and exploit such contributions by all means and in all media and formats whether now known or hereafter invented throughout the Universe for the full period of copyright including any extensions and renewals thereto and thereafter insofar as is possible in perpetuity. Furthermore, you irrevocably grant all consents and waivers as may be required under the Copyright Act of the Republic of Singapore (as may be amended from time to time) or any similar laws of any jurisdiction to enable us to make fullest use of the Contest or any part thereof without restriction. For the avoidance of doubt, we may edit, adapt, translate or remove any part of your Submission and/or contributions to the Contest.
• For the avoidance of doubt, you acknowledge and agree that the copyright and all intellectual property rights in and to the format of the Contest (and anything relating thereto) vests in us. No fees, royalties, residuals or other consideration will be payable to you in respect of participation in the Contest, in any special or additional segments of the Contest, any broadcast, subsequent rebroadcast or retransmission or any other use by use (or any of our assignees or licensees) of the Contest or any part thereof in any manner or media now known or hereafter invented.
• You agree that we will not be liable to you for any loss or damage caused as a result of your participation in the Contest.
• Mediacorp’s decision at all stages of the Contest (including without limitation the selection and number of judges) is final. No enquiries, appeals, verbal or written, shall be entertained. You shall accept and abide by any and all decisions made by Mediacorp and/or the judges concerning, without limitation, these Terms and Conditions, the Official Rules, the award of prizes, and any other matters relating to the Contest.
• All prizes won by a winner in the Contest shall not be transferable nor exchangeable for cash or otherwise. Mediacorp does not undertake any responsibility to ensure that prizes will be delivered by the sponsors to any prize winner or that the prizes are free from any defect. No agreement shall arise or be constituted, and no obligation will be incurred by Mediacorp or by its related/affiliated companies, officers and/or agents by reason of your participation in the Contest or by reason of anything done or omitted to be done by you as a result of or on account of the Contest. In the event that any of the sponsors fail or refuse, for whatever reason, to deliver or transfer the prize or make good on their promise or offer to the winner of a prize or the prize is defective, Mediacorp shall not be liable or responsible for losses (of any nature whatsoever) arising from such failure or refusal or defect.
• You acknowledge and agree that the receipt and redemption of any prizes offered shall be subject to you complying with terms and conditions imposed by Mediacorp and/or its sponsors in relation to the prizes. In the event that the winner of any prize, for any reason, fails to comply with such terms and conditions, any prizes won shall be forfeited by the winner and neither cash nor any other form of compensation will be supplied in lieu of that forfeited prize (or any part thereof) and Mediacorp may, in its sole and absolute discretion, select another winner in relation to such forfeited prize. Unless expressly included in the prize by Mediacorp and/or its sponsors, all taxes, costs and expenses in relation to the receipt, redemption and usage of the prizes will be borne by the winner.
• You shall not, without the prior written consent of Mediacorp, speak to the press or other media nor give any interviews or comments relating to the Contest, your participation in the Contest or any other participants in the Contest, nor disclose any information whatsoever relating to the Contest, Mediacorp and/or any company in Mediacorp. Without prejudice to the generality of the foregoing, you undertake not to disclose any information relating to the Contest in any form or manner, without the express written permission of Mediacorp.
• Mediacorp may in its absolute discretion disqualify you from the Contest if you:
  1. fail to comply with any of these Terms and Conditions, Rules and Guidelines, any other rules or regulations in force at the recording studios/premises/locations and all applicable regulations and laws currently in force;
  2. fail to behave appropriately when taking part in the Contest;
  3. commit any illegal or immoral act or conducts himself/herself in such a manner which in the sole opinion of Mediacorp brings or tends to bring yourself, the Contest, the sponsors of the Contest or Mediacorp into disrepute, ridicule or contempt; and/or
  4. become mentally, physically or otherwise incapacitated which in the sole opinion of Mediacorp renders you incapable of performing your obligations hereunder.
  A disqualified participant shall immediately stop in any further participation of the Contest. Any prizes won shall be forfeited and returned. Notwithstanding the disqualification of any participant howsoever, Mediacorp remains entitled to all rights assigned and granted to Mediacorp under this Agreement.
• In the event of any dispute concerning the operation of any element of the Contest (including these Terms and Conditions and Official Rules), the decision of Mediacorp is final. No enquiries, appeals, verbal or written, shall be entertained. You shall accept and abide by any and all decisions made by Mediacorp and/or the judges concerning, without limitation, these Terms and Conditions, the Rules and Guidelines, interviews with contestants, the award of prizes, and any other matters relating to the Contest.
• Mediacorp may at any time freely assign any or all of its rights, benefits and interest and/or transfer any of its obligations or liabilities arising out of these Terms and Conditions to any party without notice to or consent from you.
• Your personal data will be collected, used, disclosed and/or processed by Mediacorp for the following purposes:
  1. for the purposes of this Contest;
  2. for verification and record of personal particulars including comparing it with information from other sources and using the information to communicate with you;
  3. for research and analysis, including surveys and polls;
  4. to send you notices, information, promotions and updates including marketing and advertising materials in relation to Mediacorp’s goods and services and those of third party organisations selected by Mediacorp; and
  5. to comply with any request from any third party or any order of court or directive from authorities investigating any alleged offence or misconduct or for the purposes of taking legal action against a contestant.
• By agreeing to these Terms and Conditions, you:
  1. consent to Mediacorp collecting, using, disclosing and/or processing your personal data for the purposes as described in the clause above; and
  2. consent to Mediacorp transferring your personal data out of Singapore to Mediacorp’s third party service providers or agents for the purposes as described in the clause above.

• These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore. You irrevocably submit to the non-exclusive jurisdiction of the courts of the Republic of Singapore. No third party shall have any rights to enforce any of these Terms and Conditions against Mediacorp under the Contracts (Rights of Third Parties) Act 2001 of the Republic of Singapore.
