General Terms and Conditions of Use
1.1 Applicability. These general terms and conditions of use ("General Terms") apply to:
(a) the use of this website ("Site"), which is owned and/or operated by Mediacorp Pte Ltd ("Mediacorp") and/or its related companies (collectively, "Mediacorp Group"; for the avoidance of doubt, a reference to the Mediacorp Group includes a reference to any one company in the Mediacorp Group);
(b) any specific goods or services offered, supplied, produced, provided and/or delivered by the Mediacorp Group (collectively, the "Services"), whether via this Site or any other sites that are owned and/or operated by the Mediacorp Group; and
(c) any goods and/or services offered made available by applications made and/or offered by the Mediacorp Group, that you may download and install, or that may come pre-installed, on supported operating systems and/or devices (collectively, “Apps").
In addition, the use of any Site, Service or App may be governed by additional, specific terms and conditions (“Specific Terms") which will impose additional terms and conditions specific to the relevant Site, Services and/or Apps, and which will be deemed incorporated into these General Terms (collectively, the “Agreement"). In the event of any conflict or inconsistency between any of the provisions in these General Terms and any Specific Terms, the applicable Specific Terms shall prevail.
1.2 meconnect Accounts. You have the option to sign up to be a registered user of Mediacorp Sites, Services, and Apps (“meconnect Account”), using the application forms or social media sign on functionality made available on the Site, Services, and/or Apps. Some portions of the Site, Services, and/or Apps are only available to parties who have a meconnect Account. Mediacorp uses a single, universal meconnect Account across its properties, and as such, your meconnect Account will enable access and use, and be enabled for use, on other Services and Apps. In particular, your meconnect Account:
(a) enrols you, and allows you, to participate in Mediacorp’s rewards programme, merewards; and
(b) where supported, enables personalised features on certain Sites, Services, and/or Apps;
subject to each of their respective Specific Terms.
1.3 By accessing or using the Site, Services, and/or Apps, you agree to be bound by these General Terms and applicable Specific Terms, as well as any other policies, rules and regulations that may be imposed and/or required by Mediacorp from time to time.
1.4 Amendments. These General Terms and any Specific Terms may be amended by Mediacorp or any company in the Mediacorp Group from time to time. Such amendments may be posted on the Site or on any of the other sites and/or Apps owned and/or operated by the relevant Mediacorp Group company. You are responsible for being aware of such changes, and your continued use of the Site, Services and/or Apps shall be deemed and construed as your conclusive and binding acceptance of the amended terms.
2. PAID GOODS AND/OR SERVICES; PAYMENT
2.1 Paid content. Some of the products, services, and/or content made available on the Site, Services and/or Apps (whether from Mediacorp or from a third party) will require a purchase before becoming available for use (“Paid Content”). Such Paid Content may be subject to individual terms and conditions in addition to the terms and conditions in the General Terms and any Specific Terms. By purchasing such Paid Content, you also agree that you will be bound by such individual terms and conditions and agree to pay for Paid Content through the Site, Services and/or Apps.
2.2 Method of payment. Unless otherwise stated, payment may be made by Visa, Mastercard and/or any other methods which may be clearly advertised on the Site, Services or Apps, from time to time. You agree that Mediacorp may charge your charge card or other account(s) and/or payment methods for any content, products or services purchased and for any additional amounts (including any taxes and late fees, as applicable) that may be accrued by or in connection with your account.
2.3 Time of payment. You are liable to pay for Paid Content at such charges and at such times as stated in the terms and conditions accompanying such Paid Content, or such charges and times that Mediacorp may determine from time to time. Payment for subscription based Paid Content will be billed in advance at monthly intervals or such intervals as may be determined by Mediacorp. Payment for all other Paid Content will be billed at the point of sale. All fees are due and payable as soon as the bill is issued, and must be settled by the payment date stated on the bill. The total price on the bill will include the price of the good or service plus any applicable goods and services tax.
2.4 Disputes. In the absence of fraud or manifest error, and subject to this clause, Mediacorp may rely on each bill as conclusive evidence against you of the accuracy, completeness and truth of all matters stated in it. If you wish to reasonably dispute any amount in the bill, you may withhold payment for such disputed amounts if you inform us in writing prior to the payment date shown on the bill. Otherwise, you are liable to pay us all the charges stated in the bill. Mediacorp will investigate any such dispute and provide a written response to you within 30 days from the day Mediacorp is notified of such a dispute. If the dispute is resolved in Mediacorp’s favour, you must pay Mediacorp the disputed amount and all costs incurred in recovering the amount. Mediacorp may charge interest on the outstanding amount at 1.5% per month from the date the outstanding amount was due and payable and calculated on a daily basis or at such other rates as we may prescribe from time to time. Alternatively, Mediacorp may charge the standard late payment fee as we may prescribe from time to time. If Mediacorp agrees there is a mistake in the bill, Mediacorp will adjust the next bill accordingly. If you have already paid a bill and subsequently choose to contest it, any such dispute must be raised in writing to Mediacorp not later than 1 year from the date of that bill.
2.5 Your responsibilities. For the avoidance of doubt, you are responsible for:
(a) the timely payment of all fees, without any counterclaim, deduction, set off or withholding whatsoever;
(b) ensuring and confirming that the credit card (or other payment method) that is being used is yours, or that you have been specifically authorized by the owner of the credit card (or other payment method) to use it;
(c) providing Mediacorp with a valid charge card or payment account details for payment of all fees, keeping Mediacorp up to date on any changes. Any change in payment methods may temporarily disrupt your access to the Site, Services and/or Apps, while Mediacorp verifies your new payment information; and
(d) complying with any terms and conditions and charges imposed by third party service providers in connection with payment gateway services they provide to facilitate your online payments.
2.6 No refund. All sales and purchases of Paid Content are final and are, unless otherwise expressly stated in each product description, non-refundable.
2.7 Prices subject to change. Prices for Paid Content may change at any time. Mediacorp does not provide price protection or refunds in the event of a price reduction or promotional offering. For the avoidance of doubt, Mediacorp reserves the right to, at any time, make any change, modification and/or variation to any of the goods, services and/or content (including but not limited to price(s), content bundles and content packaging) made available on the Site, Services or Apps. Any and all such changes, modifications and/or variations will be notified on an appropriate section on a part of the Site, Services or Apps as MPL may from time to time determine.
2.8 Paid Content disclaimer. Whilst Mediacorp will try and ensure that all details (including but not limited to product description, stock availability and pricing) which appear on the Site, Services or Apps are accurate, Mediacorp does not warrant the accuracy, completeness, reliability or currency of such details. Products sold and/or delivered may therefore differ from the product images presented on the Site, Service or Apps. Mediacorp reserves the right to correct any errors, inaccuracies or omissions in information and to change or update such information at any time without prior notice and without incurring any liability to you, regardless of whether you made any order or purchase based on such errors, inaccuracies, or omissions.
2.9 Additional disclaimer for third party Paid Content. Where you purchase any Paid Content made available by third parties (whether such Paid Content is made available via advertisements displayed on the Site, Services or Apps, or via sections of the Site, Services or Apps enabling the purchase of third party Paid Content), you expressly acknowledge and agree that the Site, Services or Apps acts as a venue only. Mediacorp is not involved nor responsible for:
(a) the correctness, accurateness, or truthfulness of any information that is made available or posted on the Site, Services, or Apps;
(b) the posting, provision, delivery of such information from Mediacorp to you; or
(c) the provision of the third party Paid Content.
Any dispute relating to third party Paid Content must be brought to the third party and not to Mediacorp.
3.1 Territory. Certain Sites, Services and/or Apps may only be made available in Singapore. Otherwise, the Site, Service and/or App may be accessed by you in any part of the world, provided that it is legal for you to do so in the territory that you are accessing the Site, Service, or App, from. You undertake and warrant that you are legally entitled and able to use the Site, Services, and/or Apps.
3.2 Notwithstanding the foregoing, neither the Site, nor any of the Services or Apps, are intended for persons resident in the European Union.
3.3 Eligibility of Mediacorp employees. Employees of Mediacorp and its affiliates, contractors, vendors, sponsors and advertisers, and each of their immediate family members and individuals living in the same households of each of these individuals, are eligible to use the Site, Services, and/or Apps. However, these individuals may not participate in any lucky draws and/or contests offered through the Site, Services, and/or Apps.
3.4 Age. Use of any Site, Services and/or Apps may be subject to specific age restrictions. Unless otherwise stated, if you are under the age of eighteen (18)_years old, you must obtain the permission and consent of your parent or legal guardian and agree to these General Terms and any applicable Specific Terms to use the Site, Services and/or Apps, or to register a meconnect Account.
3.5 Mediacorp reserves the right, in its sole discretion, to determine whether any particular individual is eligible to use the Site, Services, and/or Apps, and to accept and/or reject any application for membership or meconnect Account.
4. meconnect ACCOUNT
4.1 In respect of your meconnect Account:
(a) you warrant that all information provided by you, including all information provided in the application form(s) is true, correct and complete;
(b) you warrant that you have the capacity and power to enter into this Agreement and use the services provided on the Site and/or Services; and
(c) shall keep all of the information that you have provided updated, accurate and complete.
4.2 You must keep the meconnect Account and information related to your meconnect Account (such as your login identification, password, security question, and/or any pin numbers) confidential, safe and secure. You are solely responsible for maintaining the confidentiality and security of your account and for all activities that occur on or through your account, and you agree to immediately notify Mediacorp of any security breach of your account. Mediacorp shall not be responsible for any losses arising out of the unauthorised use of your account at any time. In particular, you must not:
(a) disclose your meconnect Account identification or password to any other party; or
(b) allow any other party to use or share your meconnect Account.
4.3 Mediacorp may decline and refuse registrations at its sole discretion and for any reason without the need to give any reason to you or any third party.
4.4 Other users will be similarly responsible for all use of their respective meconnect Accounts. Without affecting any limitation or exclusion of liability elsewhere in this Agreement, Mediacorp will not be responsible or liable, directly or indirectly, for any damage, injury or loss sustained by you or any other party whatsoever and howsoever caused by or in connection with any use made by other users of their respective registered accounts.
4.5 Account deletion. You may choose to delete your meconnect Account at any time. This action is irreversible and will permanently disable your meconnect Account, and the information associated with your meconnect Account will, subject to Clauses 4.6 and 4.7 below, be deleted. Accordingly, if you delete our meconnect Account:
(a) you will immediately lose all access to functionality on the Site, Services and/or Apps that depend on your meconnect Account and/or the information contained therein;
(b) you will immediately forfeit and lose access to any Paid Content, even if you have already made payment, and no refund will be given to you;
(c) any and all rewards accrued to you through your participation in merewards will be forfeited; and
(d) you will not be able to reactivate your meconnect Account using the email address associated with that meconnect Account.
Please refer to the Specific Terms of the relevant Site, Services and/or Apps for specific consequences of deletion.
4.6 While Mediacorp will make reasonable efforts to delete your personal data, some personal data may still remain on our systems:
(a) for the purposes of complying with any legal obligations, such as the preservation of evidence or to comply with the request of any judicial or administrative authority, law enforcement agency, or other government agency; or
(b) where otherwise permitted by law.
4.7 Your request to delete your meconnect Account will not delete user content (Your Information as defined in Clause 6.5, below), nor will it terminate any licenses you have granted to Mediacorp with respect to Your Information herein this Agreement.
5.1 Subject to these General Terms and any Specific Terms, Mediacorp grants you a non-exclusive, non-transferable, revocable right to use the Site, Services and Apps for your personal and non-commercial use only.
6. CONTENT AND INTELLECTUAL PROPERTY
6.1 Mediacorp Content. All of the:
(a) content (including without limitation all text, photographs, graphics, video and audio content) located on the Site, Services, and/or Apps);
(b) compilation(s) (meaning the collection, arrangement and assembly) of all content on the Site, Services and/or Apps; and
(c) software used on the Site, Services and/or Apps;
is the property of Mediacorp, its related companies, its content suppliers and/or its software suppliers, and protected by Singapore and international intellectual property laws (including without limitation copyright and trademark laws).
6.2 All rights in and to the foregoing are reserved by Mediacorp, its related companies, its content suppliers and/or its software suppliers, and save as expressly permitted herein, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, repost or in any way exploit any part of this Site, Services and/or Apps for any purpose.
6.3 Without limiting the foregoing provisions, you shall not make use of the content of the Site, Services and/or Apps in any manner that constitutes an infringement of Mediacorp’s, its related companies’, its content suppliers’, and/or its software suppliers’, rights (including copyright).
6.4 Trade marks. The names, trademarks, service marks and logos (the “Trade Marks”) displayed on the Site, Services and/or Apps are registered or unregistered Trade Marks of Mediacorp, its related companies, its content suppliers, and/or its software suppliers. Nothing on the Site, Services or the Apps should be construed as granting by implication, estoppel or otherwise, any license or right to use any such Trade Marks. Mediacorp prohibits use of the Trade Marks as a “hot” link or in-link to any Site or other site unless establishment of such a link is approved in advance by Mediacorp in writing.
6.5 User Submitted Content. Mediacorp or the relevant Mediacorp Group company may provide facilities on the Site, Services and/or Apps to permit you to submit materials, information, articles, photographs, text, graphics, video and/or audio content (“Your Information”) to Mediacorp or to the Site and/or Services directly. You are solely responsible for Your Information, and Mediacorp and/or the relevant Mediacorp Group company acts as a passive conduit for your online distribution and publication of Your Information. With respect to Your Information:
(a) Your Information (or any materials contained therein) shall not:
i. be false, fraudulent, inaccurate or misleading;
ii. infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
iii. violate any law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
iv. be defamatory, libellous, offensive, unlawfully threatening or unlawfully harassing;
v. be obscene or contain child pornography or anything adult in nature or harmful to minors;
vi. contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; or
vii. create liability for any company in the Mediacorp Group or cause any company in the Mediacorp Group to lose (in whole or in part) the services of its ISPs or other suppliers.
(b) You may not submit any of Your Information if Your Information or the submission thereof could cause any company in the Mediacorp Group to violate any applicable law, statute, ordinance or regulation.
(c) You hereby grant the Mediacorp Group a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub licensable (through multiple tiers) right to use and to exercise the copyright and publicity rights you have in Your Information, in any media now known or not currently known, with respect to Your Information.
(d) You shall not assume a false identity or the identity of some other member when using the Site or transmit libellous, harassing, vulgar or otherwise objectionable messages through the Site; or post materials subject to copyright or other intellectual property rights claimed by any third party; or use the Site for any unlawful or illegal activities (including spamming the other users by sending unsolicited e-mails).
6.6 Feedback. Your Information may contain information that can, directly or indirectly, be used to improve the whole or part of any Site, Services, and/or Apps (“Feedback”). Feedback may include suggestions, comments, ideas, or survey responses. The Mediacorp Group shall be free to use, disclose, reproduce, or otherwise exploit all Feedback as it sees fit and without obligation or restriction of any kind to you. For the avoidance of doubt, you will not, through your provision of Feedback, acquire any rights or licenses in the Site, Services, and/or Apps.
6.7 Removal of Your Information. The Mediacorp Group shall have the right, but not the obligation, to monitor the content on the Site and/or Services, and shall have the right to remove or delete any material (including Your Information) that it, in its sole discretion, finds to be in violation of any applicable laws, codes, rules or regulations. The Mediacorp Group shall have the right to remove any material (including Your information) submitted to or posted on the Site and/or Services. Without limitation to the foregoing, The Mediacorp Group shall have the right to remove any material (including Your Information) that it, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable or inappropriate without having to assign any reason therefor.
6.8 Participation. You agree and acknowledge that all discussion for ratings, comments, bulletin board service, chat rooms and/or other message or communication facilities, including but not limited to third party sites, applications and/or facilities which may be linked to the Site, Services and/or Apps (collectively “Communities”) are public and not private communications, and that, therefore, others may read your communications without your knowledge. The Mediacorp Group does not control or endorse the content, messages or information found in any Community, and, therefore, it specifically disclaims any liability concerning the Communities and any actions resulting from your participation in any Community, including any objectionable content. Generally, any communication which you or any other person posts to the Site, Services or Apps (whether in chat rooms, discussion groups, message boards or otherwise) is considered to be non-confidential. If particular web pages permit the submission of communications that will be treated by the Mediacorp Group as confidential, that fact will be stated on those pages. By posting comments, messages or other information on the Site, Services and/or Apps, you grant the Mediacorp Group the right to use such comments, messages or information for promotions, advertising, market research or any other lawful purpose without territorial, time or other limitation.
6.9 Linked Content. The Site and/or Services may provide you with opportunities to link to, or otherwise use, sites and services offered through or by third-parties. Your use of these third-party services is subject to terms posted by the aforementioned third-parties. The Mediacorp Group has no control over any third-party site or service and it is not responsible for any changes to any third-party service or for the contents thereof, including, without limitation, any links that may be contained in or accessible through such third-party service. These links are provided solely as a convenience to you. You will need to make your own independent judgment regarding your interaction with these third-party sites or services. Our inclusion of advertisements for, or links to, a third-party site or service does not constitute an endorsement of such third party site or service.
7. USAGE RESTRICTIONS
7.1 Without prejudice to any restrictions set out elsewhere in the General Terms or any Specific Terms, the following restrictions shall apply to your use of the Site, Services, or Apps. You MUST NOT, and you must not ATTEMPT to:
(a) display, print, save, cache, copy, reproduce, change, alter, modify, or create any derivative work of, any or any part of the Site, Services, Apps, or any meconnect Account(s);
(b) communicate, distribute or make available for download in any way (including, without limitation, from or through any computer or server or network) any or any part of the Site, Services, Apps, or any meconnect Account(s);
(c) offer, sub-sell, lend, rent, lease, sub-license, or otherwise grant to any third party any right in respect of, or exploit in any way for personal or other gain, any or any part of the Site, Services, Apps, or any meconnect Account(s);
(d) hack, bypass or gain unauthorised access into any part of the Site, Services, Apps, or any meconnect Account(s);
(e) deeplink from any other website to, or frame on any other website, any or any part of the Site, Services, Apps, or any meconnect Account(s);
(f) use any device, software or routine to interfere or attempt to interfere with the proper working of; or interfere with any other user’s access or use of any part of; the Site, Services, Apps, or any meconnect Account(s); or impose any unreasonable or disproportionately large load on Mediacorp’s, its related companies’, and/or its service provider’s infrastructure;
(g) use any robot, spider, other automatic device, or manual process to monitor or copy any or any part of the Site, Services, Apps, or any meconnect Account(s);
(h) use any or any part of the Site, Services, Apps, or any meconnect Account(s) for sending out unsolicited e-mails;
(i) assume a false identity or the identity of some other registered user to access or use any or any part of the Site, Services, Apps, or any meconnect Account(s); or
(j) use any or any part of the Site, Services, Apps, or any meconnect Account(s) in any way that
i. will or could violate, or that will or could result in any company in the Mediacorp Group violating, any law, statute, ordinance or regulation (including, without limitation, those governing export control, consumer protection, unfair competition, anti-discrimination and false advertising), or code of practice, direction, order, or guideline issued by any regulatory authority;
ii. cause any form of loss or damage to any company in the Mediacorp Group or any third party (including, without limitation, loss of reputation and goodwill);
iii. create any liability for any company in the Mediacorp Group; or
iv. cause any company in the Mediacorp Group to lose (in whole or in part) the services of any Internet or telecommunication service provider or any other supplier of products and/or services.
8.1 No warranty. The Site, Services and/or App are provided on an “AS IS WHERE IS” basis. No company in the Mediacorp Group makes any representation or warranty, express or implied (to the extent permitted by law):
(a) as to the use, security, accuracy, reliability, non-infringement, satisfactory quality or fitness for any particular purpose of the Site, Services and/or App; and
(b) that the use of the Site, Services and/or App will be uninterrupted and free of any viruses or bugs.
8.2 Advertising and related services. Where you subscribe for any services on the Site, Services and/or App, that relates to any advertisement or other similar services, whether as a potential seller or a potential buyer, you hereby expressly acknowledge and agree that the Site, Services and/or App acts as a venue only, and no Mediacorp Group company is involved or responsible for the correctness, accurateness or truthfulness of any information that is posted by other users of the Site, Services and/or App; or the posting, provision, delivery of such information to you.
8.3 Access. No Mediacorp Group company shall be responsible for any connection or access to the Site, Services, and/or Apps by you. You are responsible for providing your own communications equipment and subscribing to a communications service provider to access the Site, Services and/or Apps, as well as any charges (such as Internet access charges) thereon.
8.4 Security. Certain data transmissions between your computer and the Site, Services and/or App, are conducted through secure servers and protected by Secure Socket Layer (SSL) technology. Certain services further require you to register, use passwords and/or digital signatures. While the Mediacorp Group will use reasonable endeavours to provide reasonable precautions to protect any information or material that is confidential in nature, it does not guarantee that information transmitted through the internet is secure or that such transmissions will be free from delay, interruption, interception or error. Furthermore, although the Mediacorp Group intends to take reasonable steps to prevent the introduction of viruses, worms, "Trojan horses" or other destructive materials to the Site, Services and/or App, Mediacorp does not guarantee or warrant that any Site, Services, App, or materials that may be downloaded from the Site, Services and/or App do not contain such destructive features. No Mediacorp Group company shall be liable for any damages or harm attributable to such features.
8.5 Third party conduct. You specifically acknowledge that no Mediacorp Group company is liable for the defamatory, offensive, or illegal conduct of other users or third-parties and that the risk of injury from the foregoing rests entirely with you.
8.6 LIMITATION OF LIABILITY. IN NO EVENT SHALL MEDIACORP, ITS SUBSIDIARIES, AFFILIATES, ASSOCIATES AND RELATED COMPANIES, INCLUDING THE EMPLOYEES OF ALL OF THE FOREGOING, BE LIABLE TO YOU AND/OR TO ANY PARTY FOR ANY DAMAGES, EXPENSES, CLAIMS, COSTS OR LOSSES OF ANY KIND, INCLUDING WITHOUT LIMITATION, INCIDENTAL, INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING LOST REVENUES OR PROFITS, LOSS OF BUSINESS OR LOSS OF DATA, (OTHER THAN FOR DEATH OR PERSONAL INJURY RESULTING DIRECTLY FROM YOUR USE OF THE SITE, SERVICES AND/OR APP, CAUSED IN WHOLE BY MEDIACORP’S NEGLIGENCE) ARISING OUT OF ANY LEGAL CLAIM (WHETHER IN CONTRACT, TORT OR OTHERWISE), YOUR USE OF OR INABILITY TO ACCESS OR USE THE SITE, SERVICES, APPS, USER ACCOUNT(S), PAID CONTENT, AND/OR THE CONTENT OF THE HYPERLINKS, INCLUDING BUT WITHOUT LIMITATIONS, SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES. ANY CLAIM AGAINST MEDIACORP, ITS SUBSIDIARIES, AFFILIATES, ASSOCIATES AND RELATED COMPANIES, INCLUDING THE EMPLOYEES FO ALL OF THE FOREGOING, SHALL BE LIMITED TO THE AMOUNT YOU PAID, IF ANY, FOR USE OF THE SITE, SERVICES, AND/OR APP.
9. PERSONAL DATA
9.1 Your personal data will be collected, used, disclosed and/or processed by the Mediacorp Group for the following purposes:
(a) for the Mediacorp Group or its designated representatives or business partners to provide goods and services to you or parties designated by you and matters ancillary thereto;
(b) to verify and process payment when you purchase goods and services from the Mediacorp Group;
(c) for verification and record of your personal particulars including comparing it with information from other sources and using the information to communicate with you;
(d) for research and analysis, including surveys and polls;
(e) for the Mediacorp Group or its designated representatives to conduct market research and analysis, and offer surveys to you, in relation to the Site, Services, and/or Apps;
(f) to send you notices, information, promotions and updates including marketing and advertising materials in relation to the Mediacorp Group’s goods and services and those of third party organizations selected by the Mediacorp Group; and
(g) to comply with any request from any third party or any order of court or directive from authorities investigating any alleged offence or misconduct or for the purposes of taking legal action against any you.
9.2 By using the Site and/or the Services and/or agreeing to these General Terms of Service, you:
(a) consent to the Mediacorp Group collecting, using, disclosing and/or processing your personal data for the purposes as described above; and/or
(b) consent to the Mediacorp Group transferring your personal data out of Singapore to any of the Mediacorp Group’s third party service providers or agents for the purposes as described above.

10. SUSPENSION AND TERMINATION
10.1 Any company in the Mediacorp Group may suspend and/or terminate your use of and/or access to all or part of any Site, Services, Apps, Paid Content or meconnect Account, with or without notice to you, if in its sole discretion it determines that:
(a) you have breached the terms of these General Terms or any Specific Terms, or violated or acted inconsistently with the letter or spirit of these General Terms or any Specific Terms;
(b) you have violated the rights of or any third party;
(c) it reasonably suspects that you are using and/or allowing the Site, Services, Apps, and/or meconnect Account(s) to be used for illegal, improper and/or fraudulent purposes. In such event, you will also be referred to the relevant authorities without notice, and Mediacorp will comply with the directions or guidelines issued by these authorities without further reference to you;
(d) you become or threaten to become a bankrupt under the laws of any jurisdiction applicable to you;
(e) you pass away; or
(f) for any other reason whatsoever.
10.2 Any Mediacorp Group company may modify or discontinue the Site, Services, or Apps, with or without notice to you, and it will not be liable to you or any third party as a result of such modification or discontinuation.
11.1 You agree to defend and hold Mediacorp, its affiliates and related companies from and against all claims, losses, damages, costs and expenses, including legal fees on an indemnity basis, arising out of your use of the Site and/or Services or any breach of this Agreement. In addition, Mediacorp may use whatever information that is available about you to stop any such breach or any unlawful or inappropriate use of the Site and/or Services, including informing any third party Mediacorp deems appropriate of such breach or use and/or disclosing your personal information to such third party.
12.1 Severability. If any of these terms is held to be invalid or unenforceable, such term shall be struck out and the remaining terms shall be enforced. Any failure to act by any Mediacorp Group company with respect to any breach by you or others of any of the provisions of these General Terms of Service or any Specific Terms of Service does not waive its right to act with respect to subsequent or similar breaches.
12.2 Electronic transactions. You hereby acknowledge and agree:
(a) that all electronic communications made pursuant to the use of this Site, or any Service and/or App, shall be given legal effect, validity and enforceability and shall have, between the parties thereto, comparable evidential value to that accorded to a signed written document;
(b) not to contest the legally binding nature, validity or enforceability of any transaction on the Site, or any Service and/or App on the ground that it was entered into electronically;
(c) to expressly waive any and all rights it may have to assert any such claims and shall comply with all relevant laws concerning electronic communications; and
(d) any and all transactions, including but not limited to the passing of risk and/or title to any and all products and/or goods purchased and/or transacted on the Site and/or any Service and/or App, shall be deemed and construed to be transacted, transferred and/or passed to you in the Republic of Singapore.
12.3 Governing laws and dispute resolution. These General Terms and Conditions and any Special Terms and Conditions shall be governed by the laws of the Republic of Singapore. Any dispute arising out of the use of the Site or any Services shall be referred to arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force, which rules are deemed to be incorporated by reference into these terms and conditions.
merewards – Specific Terms and Conditions
1. INTRODUCTION AND ELIGIBILITY
1.1 These are Mediacorp’s Specific Terms for the rewards that we offer to our users who are entitled to participate in Mediacorp’s loyalty and rewards programme (“merewards Programme”). They are supplemental and in addition to the General Terms. Capitalised terms that are not defined here shall have the same meaning as set out in the General Terms.
1.2 Membership enrolment fee is presently waived.
1.3 Only individual persons are eligible for merewards Programme membership and each member may maintain only one merewards Programme account. Companies and other legal entities cannot be enrolled as members.
1.4 merewards Programme accounts are not transferable. Enrolment of several persons in a single account (joint account) and multiple enrolments by a single person are not allowed.
2.1 By participating in certain rewards program(s) made available by, or by making certain selected and tracked purchases:
(a) with Mediacorp, any Mediacorp Group company, or any selected merchants or service providers (“merewards Cashback Providers”); and
(b) in the manner specified herein;
you can earn a specified amount of cashback (“Cashback”).
2.2 Earning Cashback. You may only earn Cashback if expressly stated by us, and subject to the following additional conditions:
(a) You must have a meconnect Account in order to earn Cashback.
(b) If your Cashback is tied to a purchase, Cashback will only be earned when the merewards Cashback Provider successfully receives payment from you for any goods or services purchased, and the merewards Cashback Provider credits the Cashback back to Mediacorp.
(c) Each merewards Cashback Provider will have specific instructions that you must follow in order to earn Cashback, and if the Cashback is associated with an individual promotion, there may be additional conditions and requirements associated with such promotion that must be adhered to. You must comply with such instructions, conditions, and requirements.
(d) The amount of Cashback will vary and is subject to change at any time, with or without notice.
2.3 Cashback that has not yet been earned in accordance with clause 2.2 of these Specific Terms will be marked as “Pending Cashback” in your merewards dashboard. Cashback that has been earned, will be marked as “Redeemable Cashback”.
2.4 Instructions. You are solely responsible for following all instructions, failing which you may not receive your Cashback, in full or in part. In addition to any such specific instructions, you must observe the following:
(a) ensure that cookies are enabled on both the merewards website and the merewards Cashback Provider website(s);
(b) ensure that the same device and browser is used throughout the ordering process;
(c) ensure that you do not open a separate tab or browser window while accessing the relevant merewards Cashback Provider website;
(d) ensure that, after being redirected to the merewards Cashback Provider website, you complete the transaction before proceeding to any other website;
(e) complete any transaction on the merewards Cashback Provider website within a given period of time, if any;
(f) whitelist the merewards site and the merewards Cashback Provider websites if you use any adblock software (or disable the adblock software); and
(g) you must not engage in any fraudulent or dishonest conduct, whether in relation to this Agreement, the merewards Programme, the merewards Cashback Provider, or otherwise.
2.5 Payout. Once your Redeemable Cashback meets the minimum threshold amount of Singapore Dollars $10.00, you may make a request to redeem that earned amount (“Payout Request”) into a Singapore bank account that you nominate to receive such Redeemable Cashback (“Specified Bank Account”).
2.6 Payout Requests are subject always to the terms herein these Specific Terms, including the important limitations set out below. In order for Mediacorp to process your request, you must:
(a) maintain, at the time of your request, an active meconnect Account (i.e., you must have made at least one transaction that successfully credited Redeemable Cashback into your meconnect Account in the past four hundred and sixty (460) days);
(b) give Mediacorp sufficient particulars of your Specified Bank Account to enable Mediacorp to act upon such request. You must be the owner of such Specified Bank Account, which must be a Singapore bank account, and which must be in Singapore dollars;
(c) ensure that you provide us accurate and complete particulars. Mediacorp will not be responsible for incorrect or incomplete particulars.
For the avoidance of doubt, Payout Requests will only be processed through the mechanisms outlined herein these Specific Terms. Mediacorp will not entertain requests for, and will not be obliged to, allow redemption, or payout, of Cashback via (for example) physical legal tender (i.e. physical notes and/or coins).
2.7 In respect of any Payout Requests:
(a) Any Payout Requests are final and non-reversible.
(b) In any 24-hour period, you may only successfully transfer a maximum of Singapore Dollars $300, and make a maximum of one (1) Payout Request.
(c) You will be responsible for any bank charges that may apply.
2.8 Upon receipt of a Payout Requests, Mediacorp will process your request, and will make reasonable efforts to (i) transfer your Redeemable Cashback into such Specified Bank Account, (ii) within 14 working days.
2.9 Expiry. Your Redeemable Cashback will expire if, for any continuous period of more than four hundred and sixty (460) days, you have not earned any Cashback in accordance with clause 2.2 of these Specific Terms. Upon expiry, the whole amount of your Redeemable Cashback will be forfeited.
2.10 The maximum amount of Cashback in your meconnect Account must not exceed Singapore Dollars $999, and you are solely responsible for ensuring the same. Mediacorp may, in its sole discretion, take any action required to ensure that this limitation is met, including requiring you to make a Payout Request or forfeit the whole or part of your Redeemable Cashback.
2.11 Deletion of meconnect Account. Your Cashback will be forfeited immediately upon our receipt of your request to delete your meconnect Account. This action is irreversible. If your Redeemable Cashback exceeds $10, please make a Payout Request and confirm receipt of your Redeemable Cashback in your Specified Bank Account, prior to deleting your meconnect Account. If your Redeemable Cashback is less than $10, it will be forfeited in any event.
2.12 Disputes. You must check your meconnect Account regularly to ensure Cashback has been properly credited. If you feel there are discrepancies or errors in any Cashback credited to you, you must report the same to us within five (5) working days of the transaction that is the subject of the discrepancy or error. Mediacorp may, in its sole discretion, investigate any such discrepancy, and any determination it makes in respect of the same shall be final. For the avoidance of doubt, nothing herein obliges Mediacorp to investigate or correct any discrepancies or errors brought to its attention.
2.13 Important limitations.
(a) The processing, transfer, and/or handling of any Cashback, is on a reasonable efforts basis only. In particular, such processing, transfer, and/or handling, is subject to, and dependent upon, third parties, including but not limited to (i) merewards Cashback Provider(s), with whom Mediacorp must verify your participation and/or purchase; and (ii) your bank; accordingly, to the extent that the processing, transfer, and/or handling of your Cashback is dependent on such third parties, Mediacorp is not responsible for the same. Without prejudice to the foregoing, any failure, delay, or error by Mediacorp in processing, transferring, and/or handling Cashback or a Payout Request, shall not be deemed a breach of this Agreement or Specific Terms, and Mediacorp shall have no liability to you for any such failure, delay, or error. For completeness and the avoidance of doubt, the Cashback in your meconnect Account, whether “Pending”, “Redeemable” or otherwise, does not constitute a debt owed to you, nor does it constitute monies held on trust by Mediacorp for your benefit.
(b) Mediacorp reserves the right to make changes to the mechanics, rules, or terms governing Cashback at any time without notice to you.
(c) Mediacorp reserves the right to make additions and/or deductions from the Cashback balance in your meconnect Account, or refuse to process any Payout Request, if it determines in its sole discretion that the Cashback was earned through fraudulent means, or on any other reasonable grounds.
(d) Cashback is only applicable for participation in rewards or incentive program(s) made available by, or purchases made with, merewards Cashback Providers. Even so, the availability of Cashback may be excluded in certain circumstances, and the amounts and extent of exclusion will vary. Such exclusions may also change without notice. Accordingly, please review the terms of participation and/or your purchase carefully. Mediacorp hereby disclaims any and all liability in connection with any incorrect information or failure to include information on any exclusion list.
(e) You are solely responsible for any and all taxes that may apply to your Cashback.
(f) Cashback can only be earned and redeemed in accordance with these Specific Terms.
(g) Cashback is not transferable.
3. REWARDS AND INCENTIVES GENERALLY
3.1 In participating in any rewards and/or incentive program administered by Mediacorp or the Mediacorp Group, you must always follow any and all instructions of that program. The program may also be subject to additional terms and conditions.
3.2 Any rewards and/or incentives are always subject to availability.
4. GENERAL DISCLAIMERS
4.1 Mediacorp does not make any warranty or representation on any product or service applicable to the Cashback; and Mediacorp does not accept any liability in respect of any of the products or services. All information and/or data included in and/or on the merewards Programme is made available for guidance only.
4.2 Your use or consumption of the product or service may be governed by different terms and conditions. It is your sole responsibility to comply with such terms and conditions.
4.3 Any dispute arising from or relating to the goods or services applicable to or redeemed using Cashback shall be settled between you and the service provider or the supplier of the said goods and services. Mediacorp shall not be liable for any claim arising from or relating to Cashback.
4.4 Mediacorp shall not be responsible for any Cashback lost or stolen while in its custody.
mewatch – Specific Terms and Conditions
1. INTRODUCTION AND ELIGIBILITY
1.1 These are Mediacorp’s Specific Terms applicable to users of our OTT video service, “mewatch”. They are supplemental and in addition to the General Terms. Capitalised terms that are not defined here shall have the same meaning as set out in the General Terms.
1.2 If you are under the age of eighteen (18), you must review this Agreement with your parent or legal guardian and agree to it before using mewatch.
1.3 In addition, some sections of mewatch may not be accessible without a valid meconnect Account. Mediacorp may decline and refuse registration of a meconnect Account in its sole discretion and for any reason without the need to give any reason to you or any third party.
2. CONTENT USAGE
2.1 Territory. Unless otherwise expressly specified, all content and services offered on mewatch are only intended and allowed for consumption in Singapore during the subscription or rental tenure.
2.2 Device and stream limits. Access to content on mewatch may be restricted to a certain number of streams, devices, and/or both. Unless otherwise stated, you will be subject to a maximum device limit of 5, and a maximum simultaneous stream limit of up to 2 per subscription package.
2.3 Restricted content.
(a) Certain content on mewatch may not be suitable for viewing by minors. You are responsible for ensuring that minors do not view such content.
(b) In addition, viewership of certain age restricted content is required to be restricted, by the Info-Communications Media Development Authority of Singapore, to viewers who use an additional personal identification number (“Parental Control Pin”).
Accordingly, mewatch enables users to require a Parental Control Pin for access to R21, M18 and/or NC16 content.
You may create and use a Parental Control Pin if you are above twenty-one (21) years of age.
By creating a Content Restriction Pin you represent and warrant that you are above the relevant age to view the relevant content. Otherwise, you must not, and must not attempt to, view such content or create a Content Restriction Pin.
(c) You may only exhibit or display R21 content in your residential unit(s) or in guest room(s) of hotels.
2.4 Additional usage rules. Mediacorp may, from time to time and in its sole discretion, add, remove, or modify usage rules. We will use reasonable efforts to keep you updated of these rules, but it nonetheless remains your sole responsibility to comply with such rules.
2.5 Cancellation of subscriptions by you. You may cancel your subscription to any of the Paid Content by notifying Mediacorp using the functionality made available for you to do so on the mewatch site. Alternatively, you may notify Mediacorp of your intention to cancel by calling Mediacorp at our mewatch Customer Service hotline or emailing us at the designated email address. Please note that you will be liable for all payments for all applicable fees up to and inclusive of the actual last date of subscription for the use of any Paid Content. Mediacorp does not provide refunds or credits for any unconsumed Paid Content, including but not limited to refunds for partial-month subscription periods.
2.6 Deletion of meconnect Account. Your access and subscription to any Paid Content will be terminated immediately upon our receipt of your request to delete your meconnect Account. This action is irreversible. Mediacorp does not provide refunds or credits for any unconsumed Paid Content, including but not limited to refunds for partial-month subscription periods.
CNA, TODAYOnline, 8World, Berita Mediacorp, AND Tamil Seithi – Specific Terms and Conditions
1.1 These are the Specific Terms applicable to users of the CNA, Todayonline, 8World, Berita Mediacorp, and Tamil Seithi Site(s), Service(s), and/or App(s) (“News Service(s)”). They are supplemental and in addition to the General Terms. Capitalised terms that are not defined here shall have the same meaning as set out in the General Terms.
2. INTELLECTUAL PROPERTY
2.1 All content and materials on the News Service(s), are the exclusive property of a Mediacorp Group company or its content suppliers, including AFP and the Associated Press. They may be downloaded or printed for your own personal and non-commercial use only. All copyright notices on downloaded or printed material must be retained. Save as specifically permitted here, you may not copy, reproduce, distribute, republish, repost, modify, transmit, make available to the public, adapt, create a derivative work or otherwise use or exploit any content on the News Service(s), in any way or for any purpose without the express written permission of the relevant Mediacorp Group company or its content suppliers (including AFP and Associated Press). In addition, you may not distribute or make available any part of the News Service(s) over any other website or any network.

1.1 These are Mediacorp’s Specific Terms applicable to users of the website, “The Wonder Shop” (“TWS”). They are supplemental and in addition to the General Terms. Capitalised terms that are not defined here shall have the same meaning as set out in the General Terms.
1.2 If you are under the age of eighteen (18), you must review this Agreement with your parent or legal guardian and obtain their agreement to take responsibility for your actions, any charges associated with your use of any of the Services and/or the purchase of any products through TWS, and your acceptance and compliance with the General Terms and these Specific Terms. If you do not have consent from your parent or legal guardian, you must stop using TWS.
1.3 You agree and acknowledge that TWS is only a platform for sellers to offer products for sale, and that the sellers shall be solely responsible for all matters relating to the sale and delivery of the products, including but not limited to ensuring that the sale of the products complies with the terms of this Agreement and all applicable laws and regulations. Mediacorp is not responsible for any claims or liability arising out of or in connection with any of the products offered for sale on TWS.
1.4 You are required to comply with any and all rules, regulations, guidelines, policies, notices and instructions relating to the purchase of products and/or any other Services provided through TWS, as may be amended from time to time.
2.1 Making Orders: You may place an order by following the instructions on TWS. You shall be responsible for ensuring the accuracy of all information you submit in respect of your order.
2.2 Reservation of rights in respect of orders: All orders shall be subject to Mediacorp’s acceptance in its sole discretion. You acknowledge that Mediacorp shall not be deemed to have accepted your order unless you receive a notice from Mediacorp accepting the order.
2.3 Pricing: The price payable for each product shall be the price as listed on TWS at the time at which the order is placed by you and transmitted to Mediacorp. For the avoidance of doubt, Mediacorp reserves the right to amend the prices listed on TWS at any time without giving any reason or prior notice.
2.4 Taxes: All prices listed are subject to taxes which shall be borne by you, unless otherwise stated.
2.5 No Cancellations by Buyer: You may not cancel or make any changes to an order once it has been submitted. Mediacorp shall be entitled (but not obligated) to process the order without any further reference or notice to you.
2.6 Cancellation by Mediacorp: Without prejudice to any other rights or remedies under this Agreement, Mediacorp may cancel any order at any time by written notice to you if:
(a) the product ordered is unavailable for any reason;
(b) you are in breach of any obligation under this Agreement;
(c) full payment for the product has not been received;
(d) there is an error in the pricing of the product on TWS; or
(e) any other reason whatsoever.
3.1 Product Description: While Mediacorp endeavours to provide an accurate description of the products based on information provided by sellers, all descriptions, images, information and materials provided on TWS in respect of the products are provided “as is” and without any express or implied warranties. Neither Mediacorp nor any of the sellers warrant that the descriptions of the products are accurate, complete or free from error. You acknowledge that the actual product you receive may vary from what is shown on TWS due to repackaging, redesign of the product or limitations of broadcast, monitor and/or screen quality.
3.2 No Representations or Warranties: Selected products may come with a warranty provided by the manufacturer of the product. You acknowledge that Mediacorp is not responsible or liable in any way for such manufacturer warranty (if any) and that Mediacorp does not give any representation or warranty (whether express or implied) as to the quality or condition of the products supplied or that they will be suitable for any particular purpose or use.
4.1 Address: The sellers of each product shall be responsible for the delivery and fulfilment of the orders for their respective products. Delivery of the products shall be made to the address provided by you. You are responsible for ensuring that the correct address is provided. Mediacorp will only inform the seller to commence delivery after full payment has been received.
4.2 Risks of Delivery: You agree that the sellers shall bear all risks attached to the delivery of the orders. If there is any damage, loss or failure of delivery during the course of delivery, you acknowledge and agree that Mediacorp shall not be liable for any loss, costs or expenses arising therefrom, which shall be the sole responsibility of the sellers.
4.3 Delivery timeframe: While sellers will make every reasonable effort to deliver the product to you within the delivery timeframe stated, you acknowledge that all delivery timeframes given are estimates only and delays can occur. If there is any delay in the delivery of your order, you will be notified accordingly. The time for delivery shall NOT be of the essence, and neither Mediacorp nor any seller shall be liable for any delay in delivery howsoever caused.
4.4 Availability of Products: Delivery is subject to availability of the products. You acknowledge that while Mediacorp endeavours to update stock information on TWS regularly, it is possible that in some instances a product may become unavailable between updates. In such event, Mediacorp reserves the right to either postpone the delivery or cancel the order and refund all monies paid, without any further liability or compensation to you.
4.5 Failure to take delivery: If you fail to take delivery of an order (otherwise than by reason of any cause beyond your reasonable control or by reason of a seller’s default) then without prejudice to any other right or remedy available to Mediacorp, Mediacorp may cancel the order without any further liability or compensation to you.
5. PAYMENT TERMS
5.1 Payment Methods: Payment for orders may be made using any of the payment methods available on TWS from time to time. The payment methods may be subject to such additional terms as may be prescribed from time to time by Mediacorp or the third party payment providers. You agree that you are subject to the applicable user agreement of your chosen payment method, and that you will not make any claim against Mediacorp for any failure, disruption or error in connection with your chosen payment method. Mediacorp reserves the right at any time to modify or discontinue, temporarily or permanently, any payment method without giving any reason or notice.
5.2 Payment by Credit Card: We take all reasonable care to make TWS secure and to prevent fraud. All credit and debit card transactions on TWS are processed by Stripe, a secure online gateway which will be responsible for holding and automated handling of the information relating to your payment details in a secure environment. Mediacorp does not retain or store your credit card information.
5.3 Failure to pay: Orders will only be processed after full payment is cleared. If you fail to make any payment pursuant to the terms and conditions of your chosen payment method or payment is cancelled for any reason whatsoever, then without prejudice to any other right or remedy available to Mediacorp, Mediacorp shall be entitled to cancel the order or suspend delivery until payment is made in full.
5.4 Wrong payment information: Mediacorp shall not be responsible or liable for any loss or damage to you arising from any wrong information provided by you, such as but not limited to delivery or payment information. Mediacorp reserves the right to check whether you are duly authorised to use a payment method, and may suspend the transaction until such authorisation is confirmed or cancel the relevant transaction where such confirmation is not available.
6. REFUNDS AND RETURNS
6.1 Return Policy: All returns must be done in accordance with the terms set out herein and the instructions set out in the Returns and Refunds Policy on TWS. You may initiate the returns process by communicating with Mediacorp in accordance with the instructions set out in the Returns and Refunds Policy. Mediacorp is not obligated to agree to any return, and all agreed returns are subject to your compliance with the Returns and Refunds Policy and all instructions to Mediacorp’s satisfaction. Mediacorp reserves the right to reject any requests for refunds or returns at its sole and absolute discretion.
6.2 Permitted Returns: Subject to Clause 6.1, within 3 days from the date of delivery of a product, you may request to return the product if it was faulty or damaged upon receipt and such damage was not due to your own action, omission or negligence. Mediacorp will review each return request and reserves the right to reject any return requests. For products that qualify for a valid return, Mediacorp may offer the following remedies at its sole discretion:
(a) Refunds: Mediacorp may offer you a partial or full refund of the price paid for the product. Any applicable refunds shall be made via the original payment method. Processing of refunds may take time and is subject to the processing timelines of the respective banks and/or payment providers. All refunds are conditional upon Mediacorp’s acceptance of a valid return of the product.
(b) Replacements: Mediacorp may offer you a repair or replacement product in place of the damaged or defective product. Once you have accepted a repair or replacement, you shall have no further claim against Mediacorp or the seller with respect to the damaged or defective product.
7. DISCLAIMERS AND LIMITATION OF LIABILITY
7.1 DISCLAIMER: MEDIACORP HAS NO CONTROL OVER AND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOES NOT GUARANTEE OR ACCEPT ANY RESPONSIBILITY FOR THE FITNESS FOR PURPOSE, CONDITION, QUALITY, SAFETY OR LEGALITY OF PRODUCTS AVAILABLE ON TWS. MEDIACORP DISCLAIMS ANY AND ALL LIABILITY ARISING FROM ANY PRODUCT WARRANTIES, PRODUCT CLAIMS AND/OR ANY DESCRIPTIONS OR REPRESENTATIONS WHICH MAY BE STATED ON THE PRODUCTS OR PROVIDED BY SELLERS, MANUFACTURERS, SUPPLIERS AND/OR MERCHANDISERS.
7.2 SOLE REMEDY: YOU ACKNOWLEDGE AND AGREE THAT YOUR ONLY RIGHT WITH RESPECT TO ANY PROBLEMS OR DISSATISFACTION WITH ANY PRODUCTS PURCHASED THROUGH TWS IS TO REQUEST FOR A REFUND OR REPLACEMENT IN ACCORDANCE WITH CLAUSE 6 ABOVE.
7.3 MAXIMUM LIABILITY: NOTWITHSTANDING ANY OTHER TERMS IN THIS AGREEMENT, THE MAXIMUM CUMULATIVE LIABILITY OF MEDIACORP AND A SELLER TO YOU OR TO ANY OTHER PARTY FOR ALL LOSSES UNDER, ARISING OUT OF OR RELATING TO THE SALE OF PRODUCTS BY SUCH SELLER THROUGH TWS, WILL NOT EXCEED THE AMOUNT THAT YOU HAVE PAID FOR THE RELEVANT PRODUCTS.
